Signs for Indiana No Smoking Law

Indiana’s new statewide smoking ban was signed into law early in 2012 and goes into effect on July 1, 2012. The new law, House Enrolled Act No. 1149 (HEA 1149), prohibits smoking in most public places and places of employment.

In addition, smoking is prohibited within 8 feet of a public entrance to a public place or place of employment.

Exemptions for this law include bars and taverns that do not allow in persons under 21 years of age and gambling facilities.

Complying with the new law requires the following:

1. Businesses in Indiana must post “conspicuous signs” at “each public entrance” to indicate that no smoking is allowed within 8 feet of each entrance.
2. Businesses in Indiana must post “conspicuous signs” to indicate that “Smoking is Prohibited by State Law.” Furthermore, restaurants in which smoking is not allowed, must post a similar sign at each entrance.
3. Businesses in Indiana in which smoking is allowed, must post “conspicuous signs” that read “WARNING: Smoking is Allowed in this Establishment.”
